These Terms of Service ("Terms") are a legal agreement between you and Fastorbit Apps ("Quokka", "we", "us", "our") governing your use of the Quokka mobile application and this website (together, the "Service"). Quokka is a family task, rewards, and optional screen-time management app for iPhone. Please read these Terms carefully. By downloading, installing, creating an account, or otherwise using Quokka, you agree to be bound by them. If you do not agree, do not use the Service.
These Terms incorporate our Privacy Policy, which explains what information we collect and how we handle it.
1. Who May Use Quokka
- You must be at least 18 years old and legally able to enter into a contract to create a Quokka family and accept these Terms.
- A minor may use Quokka only as a member of a family created by their parent or legal guardian, and only with that adult's active supervision.
- The adult who creates a family represents and warrants that they are the parent or legal guardian of every minor they add to that family, that they provide verifiable parental consent for that minor's use of Quokka, and that they are responsible for supervising that use.
- Quokka is not a social network, a friend finder, or a monitoring tool for anyone other than a parent's own minor children. Do not use it to track or restrict any other person.
2. Family Roles and What Each Can Do
Quokka has two roles, and they have deliberately different powers:
- Parents (adults) create the family, invite other adults and their own minor children, create and assign tasks, approve or reject completions, create rewards, set screen-time limits and downtime schedules, and lock or unlock a child's device where the child has authorized Apple's Family Controls on their own device.
- Kids join a family using a short invite code, see the tasks assigned to them, mark tasks complete (optionally attaching a proof photo they choose to take), earn stars, and spend stars on rewards or screen-time sessions their parent has configured.
Anyone holding a valid invite code can join the corresponding family. Treat invite codes like passwords: share them only with the intended family member, and only through a channel you trust.
3. Your Account
- Parents sign in with Sign in with Apple. You are responsible for maintaining the security of the Apple ID used to access Quokka.
- Kids do not create credentials. A kid's device uses an anonymous, device-scoped session linked to the family they joined.
- You are responsible for all activity that occurs in your family, including activity by other members you invite.
- Notify us at [email protected] promptly if you believe someone has gained unauthorized access to your family.
4. Subscriptions, Billing and Auto-Renewal
Quokka is free to download. Some features require Quokka Premium, an auto-renewable subscription sold through the Apple App Store.
- Plans. Quokka Premium is offered on weekly, monthly and yearly plans. The subscription title, exact plan length and current price in your local currency are shown on the purchase screen inside the app and on the App Store product page before you buy.
- Free trial. Where offered, a free trial is available on the yearly plan to customers who are eligible under Apple's rules. The trial length is shown on the purchase screen. If you do not cancel before the trial ends, the subscription converts to a paid subscription at the price shown.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period, at the then-current price for the plan.
- Managing and cancelling. You can manage or cancel your subscription at any time in iOS Settings → [your Apple ID] → Subscriptions. Deleting the app does not cancel a subscription.
- Payments and refunds. Apple processes all purchases; we never see your card or bank details. Refunds are handled by Apple under its own policies. You can request one at reportaproblem.apple.com. Except where required by law, payments are non-refundable by us.
- Family Sharing. Quokka Premium supports Apple Family Sharing where enabled. If a purchase is shared, entitlement is delivered by Apple, and a receiving device may need to use "Restore Purchases" once for it to appear.
- Price changes. If we change subscription prices, the change applies to future billing periods and Apple will notify you and, where required, ask for your consent before the change takes effect.
- Who pays. The subscription is normally held by a parent and covers the family. Kids do not purchase anything inside Quokka.
5. Screen-Time Features and Apple Family Controls
Quokka's screen-time features are built on Apple's Family Controls, DeviceActivity and ManagedSettings APIs. This has consequences you should understand before relying on them:
- Both the parent and the child must explicitly authorize Family Controls on their own devices. Without both authorizations, screen-time enforcement does not run.
- Family Controls is a permission to apply limits, not to observe. Quokka cannot see the content of other apps, your child's screen, their messages, their browsing history or their search queries.
- Enforcement depends on Apple's platform behaviour, on device settings, and on the child's device being functional and not, for example, powered off or restored. Quokka is a household routine tool, not a safety or supervision guarantee. Do not rely on it as the sole means of protecting a child.
- Remote lock and unlock commands are delivered by push notification and may be delayed or missed if the child's device is offline. The app reconciles state when it next syncs.
- You are responsible for using these features lawfully and appropriately with your own minor children.
6. Content You Create
- You keep ownership of the content you and your family create in Quokka: task and reward titles and notes, avatars, and any proof or cover photos you choose to attach.
- You grant us a limited, worldwide, royalty-free licence to host, store, transmit and display that content solely to operate and provide the Service to your family. We do not use your content for advertising or training and we do not sell it.
- You are responsible for the content you upload and confirm you have the right to upload it. Do not upload photos of anyone who has not agreed to be photographed.
- We may remove content that violates these Terms or the law.
7. Acceptable Use
You agree not to:
- Use Quokka to monitor, restrict or coerce any person other than your own minor child.
- Use Quokka for harassment, abuse, or any purpose that harms a child's wellbeing.
- Upload unlawful, hateful, sexually explicit or abusive content.
- Attempt to breach, probe or circumvent our security, access another family's data, or interfere with the Service's operation.
- Reverse engineer, decompile or attempt to extract source code from the app, except to the extent this restriction is prohibited by applicable law.
- Resell, sublicense or commercially exploit the Service, or use it to build a competing product.
- Use automated means to access the Service or create accounts.
8. Licence
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Quokka on Apple devices that you own or control, as permitted by the App Store Terms of Service. We retain all rights, title and interest in the Service, including its software, design and trademarks. These Terms do not grant you any right to our branding.
9. Availability and Changes to the Service
We work to keep Quokka available and reliable, but we do not guarantee uninterrupted service. We may modify, suspend or discontinue features, and we will give reasonable notice of material changes that reduce functionality you are paying for. If we discontinue a paid feature entirely, you may cancel your subscription as described in section 4.
10. Termination
- You may stop using Quokka at any time and delete your account from inside the app (Profile → delete account). Deleting a parent account may delete the family and the accounts of the children in it — the app tells you what will be removed before you confirm.
- Deleting your account does not automatically cancel an active subscription. Cancel it in iOS Settings as described in section 4.
- We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the Service or other users. Where reasonable, we will tell you why.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free, that limits will always be enforced, or that it will meet your requirements. Quokka does not provide medical, psychological, educational or legal advice; content on our website and blog is general information only.
Nothing in these Terms excludes or limits any right you have under mandatory consumer law in your country of residence.
12. Limitation of Liability
To the fullest extent permitted by law, Fastorbit Apps will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars (USD 50).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Indemnity
You agree to indemnify and hold harmless Fastorbit Apps and its personnel from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Apple-Specific Terms
- These Terms are between you and Fastorbit Apps only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
15. Changes to These Terms
We may update these Terms to reflect changes to the Service or the law. When we make a material change we will update the effective date above and surface an in-app notice before the change takes effect. Continuing to use Quokka after that date means you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription.
16. Governing Law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles. Mandatory consumer-protection rights granted to you by the law of your country of residence are not affected. Where permitted, disputes will be resolved in the competent courts of Ukraine.
